Terms and Conditions

Welcome to Mindful Movement Surrey Hills! By attending any classes or engaging in services provided by our studio, you agree to the following terms and conditions. Please read these terms carefully before booking or participating in any sessions.

1. General Terms

  • Eligibility: Our services are available to individuals aged 15 and above. Clients under 18 years of age will need a parent or guardian to sign a waiver form on their behalf before participating in class.

  • Studio Policies: All participants must adhere to our studio’s policies, including but not limited to appropriate behaviour and hygiene practices.

Personal Agreement: You agree to participate in classes with the understanding that there is a risk of injury, property loss, or death. You’re also responsible for disclosing any pre-existing conditions, injuries, or diseases and have sought appropriate medical advice in relation to any such conditions. By attending class, you waive any right to make legal claims against Mindful Movement Surrey Hills for injury or loss of any kind.

2. Bookings, Attendance & Payment

  • Booking Classes: To book a class, you must either have pre-purchased sessions in your account or pay at the time of booking via our online platform or mobile app. All bookings are subject to availability.

  • Introductory Offers: Introductory Offers are available to new clients only. These offers are valid only once and cannot be extended. The Introductory Offer activates from the date of purchase and is valid for 21 days.

3. Arrivals, Cancellations & No-Shows

  • Private Sessions: A 24-hour cancellation policy applies to private sessions.

  • Group Classes: A strict 8-hour cancellation policy applies. Cancellations must be made online through the booking system. Late cancellations will result in a $15 late fee and no-shows will result in forfeiting the class and, for members, a $20 late fee will apply. This fee will automatically be charged to your stored billing details.

  • Waitlist: If a class is fully booked, you can join the waitlist. If a spot becomes available, you will be automatically added to the class.

  • First-Time Arrivals: First-time arrivals are required to arrive at least 15 minutes before the start of class to receive an orientation to the studio.

  • Late Arrivals: For safety reasons, clients arriving more than 5 minutes late will not be admitted to class.

4. Etiquette

  • Personal Hygiene: To ensure a comfortable and enjoyable experience for all students, we kindly ask that you maintain good personal hygiene. Please refrain from using strong perfumes or colognes, as some individuals may be sensitive to fragrances. Additionally, bring a sweat towel if required and clean any equipment used with the provided sprays and towels before leaving. We appreciate you contributing to a clean and welcoming studio! We do have sweat towels for our Mindful Members (non-members can hire for a gold coin donation) and deodorant for purchase or available at the Beauty Bar.

5. Courses, Workshops & Masterclasses

  • Non-Refundable: Courses, workshops, masterclasses, and challenges are non-refundable and cannot be transferred to another individual or used in conjunction with any other offer.

6. Health & Safety

  • ·Medical Disclosure: It is your responsibility to disclose any medical conditions, injuries, or limitations before participating in any class. We recommend consulting a doctor before starting any new exercise program, especially if you have any health concerns or pre-existing conditions.

  • ·Physical Fitness: By participating in any of our classes, you affirm that you are in good physical condition and do not suffer from any known disability, injury, or medical condition which would prevent or limit your participation in exercise. You acknowledge that the programs may involve strenuous physical activity, including but not limited to, muscle strength and endurance training, cardiovascular conditioning, and other fitness activities.

  • ·Liability Waiver:
    In consideration of your participation in any exercise program at Mindful Movement Surrey Hills, you recognise and understand that there is an inherent risk of injury involved in physical activity. You voluntarily assume all risks associated with participating in exercise classes, including, but not limited to, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, joint injuries, back injuries, heat exhaustion, heart attacks, strokes, or any other illness or injury that may occur during your participation.

You hereby release Mindful Movement Surrey Hills, its owners, employees, agents, contractors, and any affiliates, from any and all liability for any injury, illness, death, or property damage that may occur as a result of your participation in our programs, whether caused by negligence or any other matter. This release includes all claims, demands, or causes of action resulting from voluntary participation, enrolment, or injuries sustained during or after participation in the program.

You fully understand the potential risks of injury, including permanent disability or death, and agree to hold harmless Mindful Movement Surrey Hills from any claims, demands, or causes of action, whether present or future, that may arise from your voluntary participation in our services. This waiver of liability is given in full knowledge and understanding of the risks involved and your voluntary acceptance of these risks.

  • ·  Responsibility for Personal Health: You are responsible for monitoring your own physical condition throughout the duration of the class. If at any time during the class you feel discomfort, dizziness, or any physical symptoms of distress, you should immediately stop and notify the instructor.

7. Privacy Policy

  • Personal Information: We respect your privacy and handle all personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988. Your personal details will only be used for booking classes, processing payments, and communicating with you about Mindful Movement Surrey Hills services.

  • Photos & Videos: Occasionally, we may take photos or videos during classes for promotional purposes. If you do not wish to be featured, please inform the instructor before the class.

8. Changes to Services & Schedule

  • Class Schedule: Mindful Movement Surrey Hills reserves the right to modify, cancel, or reschedule classes or instructors at any time. Any changes will be communicated to you via email, app notifications, or on our website.

  • Force Majeure: Mindful Movement Surrey Hills is not liable for failure to deliver services due to circumstances beyond our control, such as natural disasters, pandemics, or government-imposed restrictions.

9. Code of Conduct

  • Respect: We expect all members and staff to act respectfully and courteously at all times. Disruptive behaviour, harassment, or discriminatory actions will not be tolerated and may result in suspension or termination of your membership.

10. Modifications to Terms

  • Right to Amend: Mindful Movement Surrey Hills reserves the right to modify, update, or change these terms and conditions at any time. Any changes will be communicated via email or posted on our website. Continued use of our services after any changes will constitute your acceptance of the updated terms.

11. Governing Law

  • Jurisdiction: These Terms and Conditions are governed by the laws of the state or territory in which Mindful Movement Surrey Hills operates. Any disputes will be resolved in the courts of that jurisdiction.
